      Overview

      FOS (“FOS” or “we”, “our” or “us”) respects the privacy of individuals who visit our Front Office Sports websites, including frontofficesports.com and any other websites or subdomains that link to this Privacy Policy (collectively the “Website”) and use our Services (including our online newsletters, events, games and our merchandise shop). This Privacy Policy describes our policies and practices regarding the collection, use and disclosure of Personal Information and other information through the Website and Services. It also applies to other websites or services owned or provided by FOS and that post this Privacy Policy.

      “Personal Information,” as used in this Privacy Policy, means any information that can be used to identify an individual or a household.

      1. PERSONAL INFORMATION WE COLLECT

      Personal information we collect may fall into any of the following categories:  

      • Identifiers such as your first and last name, email address, postal address, phone number, user account name, social media handle, proof of employment eligibility and date of birth (if you are applying for a job), or other similar identifiers;
      • Protected characteristics such as your gender, age, race, or other protected classifications under applicable law;
      • Financial information such as bank or credit card numbers or other financial information used to pay for a subscription or merchandise;
      • Audio, electronic, visual, or similar information such as photographs of you, IP address or voice recordings from you when you attend one of our events;
      • Professional information such as information about your job title, employer, job history, or job interests;
      • Education information such as your education history, degrees or certifications obtained; or
      • Communications. When you participate in polls or surveys, register for an event or contact us, we may maintain a record of that communication including any Personal Data you provide in the communication.

      We may ask you to provide Personal Information when you:

      • Use our Website;
      • Request a subscription, support or other information;
      • Place orders in our Shop or for Services;
      • Create and manage a user account;
      • Register for one of our courses or other events;
      • Participate in surveys or promotional activities online or in any other venue;
      • Subscribe to marketing and promotional emails or other materials;
      • Interact with us on third party social networks (subject to that third party’s terms of use and privacy policies);
      • Apply for a job; or
      • Contact us.

      You may choose not to provide Personal Information or withdraw any consent you may have provided to our processing your information at any time, although it may affect our ability to provide you with relevant information or services.

      Information We May Collect from Third Parties

      To provide you a more consistent and personalized experience, we may combine the Personal Information we collect about you through one source with additional Personal Information obtained from other sources, including trusted business partners and other third parties.  This may include information that allows us to identify you across multiple devices through which you access our websites. 

      We may also receive Personal Information about you if you Interact with us on third party social networks (subject to that third party’s terms of use and privacy policies).  Personal Information shared from third party social networks may include your name, user name or social media handle, your photo, your email address (if available) and public profile information you choose to share through the platform.

      Examples of how we may use the Personal information we receive from third parties include using your data to help improve your experience using our Website, to present you with options tailored to your preferences, for targeted advertising purposes as explained below, and to help prevent and detect fraud.

      Information We May Collect Automatically

      As is true of most websites, our Website and Services may use cookies or similar technologies to gather certain information automatically that helps us analyze trends in the aggregate and administer our website. This information may include the following categories of Identifiers and Internet or other electronic network activity information:

      • Your operating system
      • Pages visited, time spent, and actions you take on our Website
      • Referring/exit pages
      • Approximate location derived from IP address

      Our website uses “cookies” and similar technologies (like web beacons and pixels) to enable you to use our Services, to help personalize your online experience, to analyze the functionality of our Website and Services, to help analyze usage trends and to track user activities on our Website. Cookies may also be used to deliver relevant messages to you, including marketing communications.

Web beacons, also known as pixel tags and clear GIFs, are electronic images that allow a website to access cookies and help track marketing campaigns and general usage patterns of visitors to those websites. Web Beacons also can recognize certain types of information, such as cookie numbers, time and date of a page view, and a description of the page where the Web Beacon is placed.  We may place a web beacon, for example, in marketing emails that notify us when you have clicked a link in the email.

      Online Behavioral Advertising

      We may use third-party advertising companies to place cookies and Internet browsing to help us display personalized content and appropriate advertising during your visits to our Website and other websites. For example, if you view one of our products or newsletters on our Website, you may see offers for our similar products on other websites you visit. Cookies placed by these advertising companies also assist us with measuring the performance of our advertising campaigns and with identifying the pages you view, the links and ads you click on, other actions you take on those web pages, and the site from which you came before arriving at a web page. These cookies can be effective whether you are on our Website or another website. 

      If you do not wish to have this information used for the purpose of serving you targeted ads, you may opt out of allowing us to share your Personal Information for tracked advertising purposes using our  Consent Preferences tool via the link at the bottom of our Website’s home page.  You may also opt-out of publishers’ content directly by visiting https://preferences-mgr.truste.com (or if located in the European Union click https://www.youronlinechoices.eu/). Please note this does not prevent you from being served all advertising. You will continue to receive generic ads.

      Google Analytics 

      We use Google Analytics to help us manage and improve our Website and Services. Google provides an optional Browser Add-On that allows you to opt-out of your data being used by Google Analytics.  You may download and install the Google Browser Add-On at: https://tools.google.com/dlpage/gaoptout.

       

      3. DO NOT TRACK AND GLOBAL PRIVACY CONTROL

      While you may be able to control the use of cookies through your web browser as described in the “Cookies and Similar Technologies” section above, some web browsers may also give you the ability to enable a “Do Not Track” (DNT) setting that tells a website that a user does not want their online activity to be tracked. This DNT signal is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with DNT enabled still have the ability to accept cookies.       We currently support and honor Global Privacy Control (GPC), a specification designed to allow internet users to notify businesses of their privacy preferences, such as whether or not they want to be tracked or have their personal information sold or shared with third parties for targeted advertising. GPC allows a user to set an extension in their browser or mobile device that acts as a mechanism that our Website can use to honor your privacy settings.       4. HOW WE MAY USE YOUR PERSONAL INFORMATION

      We may use your Personal Information for any of the following purposes:

      Our legal basis for collecting and using your Personal Information depends on the Personal Information concerned, the specific context in which we collect it and how it is to be used. This may be of particular relevance if you are located in the European Union, the United Kingdom, Switzerland, or another jurisdiction with similar laws.  In general, we process Personal Information under one or more of the following legal bases:

      • Performance of a contract (for example, using your email address to deliver a subscription newsletter)
      • Compliance with our legal obligations (for example, taxation and anti-money laundering laws, or where a law requires the use of your Personal Information to protect your vital interests or those of another person)
      • Legitimate interests (for example, to operate and improve our Website, providing our products and Services, conducting marketing communications or to prevent fraud), provided that our legitimate interests are not outweighed by any prejudice or harm your rights and freedoms

      You may withdraw consent at any time by contacting privacy@frontofficesports.com.  If you withdraw your consent, it will not affect the lawfulness of any processing based on your consent before you withdrew it. Where applicable, we may ask for your consent to processing at the point where you provide your Personal Information.

      FOS is a media organization and publisher. Data protection law includes certain exemptions when Personal Information is processed for the purposes of journalism. Those exemptions apply to some of the ways we use Personal Information. This Privacy Policy does not cover Personal Information we process for journalism purposes.

      6. HOW WE MAY SHARE YOUR PERSONAL INFORMATION

      We may disclose your Personal Information for any purpose with your consent. Except as described below, we will not disclose your Personal Information to third parties for their own marketing purposes without your consent.

      We may share your Personal Information with third parties for the following limited purposes:

      A. Corporate Affiliates and Subsidiaries

      We may share your Personal Information with our corporate affiliates and subsidiaries for purposes consistent with this Privacy Policy.

      B. Service Providers and Business Partners

      We may share your Personal Information with third party suppliers to help us operate our Website and provide you our Services, including to send you our newsletters or to send you information regarding a webinar you have registered to attend.  These service providers or business partners may perform advertising services, process secure payments, fulfill orders, provide technical services, serve online behavioral advertising, send newsletters and surveys, support email services, administer polls and surveys, and analyze information to help us improve our business.  

      Some trusted business partners also participate in co-branded relationships with us.  In those cases, your Personal Information may be shared with both us and the co-branded business partner.  For example, we and a business partner may co-sponsor a webinar or other event with their brands and ours on the registration page.  If you register for such an event, your Personal Information may be provided to both FOS and the co-branding business partner.  Such co-branding relationships will be clearly disclosed at the point where your Personal Information is collected.

      Some of our service providers or business partners may engage their own service providers or business partners to further assist us.  In these instances, the receiving party is not permitted to retain, use or disclose Personal Data for any purpose other than for performing the specific business purpose on our behalf.  We require each service provider or business partner to be bound by contractual clauses to protect your Personal Information in compliance with data protection legislation and to limit the receiving party from retaining, using or further disclosing the Personal Information for any purpose other than for performing the specific business purpose on our behalf.

      We use third-party payment processors for any purchases you make through the Services.  We do not have access to or store any Personal Information, including credit card numbers or other financial information, you provide to these payment processors. This Privacy Policy does not apply to them.  Please consult the individual payment processors’ privacy policies to learn how they protect your Personal Information. 

      C. Where Required by Law or for other Protective Reasons

      We may disclose Personal Information when we believe disclosure is necessary to:

      • Comply with applicable law, regulation, or legal process
      • Respond to lawful requests from public authorities
      • Protect the rights, safety, and security of FOS, our users, or others
      • Prevent fraud, abuse, or security incidents
      • Enforce our agreements and policies

      D. In the Context of a Merger, Acquisition or Sale

      We may share your Personal Information with potential transaction partners, service providers, advisors and other third parties in connection with negotiation or completion of a corporate transaction in which FOS is acquired by or merged with another company or in which we sell or transfer all or a portion of our assets or business.

      E. For Employment Purposes

      We may disclose Personal Information to a trusted third party if it is necessary to process a job application or to establish, manage or terminate an employment relationship, to the extent permitted by law.

      Except for Aggregated Information, which is described in more detail below, The Personal Information we may share with third parties as described in this section may include some or all of these categories:

      We do not sell or share Personal Information with third parties for monetary consideration; however, we may disclose certain Personal Information to third parties under circumstances that might be deemed a “sale” or ”sharing” as defined under California (CCPA), Colorado (CPA), Connecticut (CTDPA), Nevada (NRS 603A), Utah (UCPA), Virginia (CDPA) or other states’ similar consumer data privacy laws.  You may request that we exclude your Personal Information from such disclosures by opting out in our Consent Preferences tool, or direct us to limit the use and disclosure of your  Personal Information by contacting us at privacy@frontofficesports.com.  Depending on the nature of your request, you may need to provide additional identifying information in order for us to validate and process your request.

      We may share aggregated, de-identified information about our customers and Website visitors (“Aggregated Information”) with third parties. For example, we may inform third parties regarding the number of users of the Services, the activities they conduct while on the Website, the percentage of our Website visitors who live in the United States of America, or the percentage of visitors to our Website who purchase products or register for our newsletters.  Such Aggregated Information cannot be used to identify you.

       

      7. INTERNATIONAL DATA TRANSFERS

      FOS is based in the United States, and information we collect may be processed and stored in the United States or other countries where we or our service providers operate.

      We may transfer your Personal Information to our service providers or business partners, if required for the purposes described in this Privacy Policy. This may involve the transfer of your Personal Information to countries outside your home country or region – including outside the European Economic Area if that is your region – which may have a different level of data protection from your home country.  Such countries may include, without limitation, the United States and other countries in which we or our service providers maintain facilities. We take steps designed to ensure appropriate protections are in place for the transfer of Personal Information, consistent with applicable data protection laws. These steps may include contractual protections or other legally-approved transfer mechanisms. We take all reasonable technical and organizational measures to safeguard Personal Information we transfer.

      You can change your communication preferences, including opting out of all marketing communications, at any time. You may use any of the following options to express and manage your preferences:

      We or any third parties acting on our behalf will conduct any marketing activities in accordance with applicable laws and include (where applicable) methods to allow you to express your preferences (including the possibility of being removed from our advertising and marketing lists as set out above).  If you opt out of receiving marketing communications, we may still communicate with you in connection with transactions you request, your subscription and/or Services-related matters.

       

      9. UNSUBSCRIBE FROM OUR NEWSLETTERS

      Should you no longer wish to receive our Newsletters, you may click on the unsubscribe link located at the bottom of each message received or contact us at privacy@frontofficesports.com, and we will promptly remove you from our distribution list.

       

      10. YOUR PRIVACY CHOICES AND PERSONAL DATA RIGHTS

      A. Access and update your information

      We want to help you keep your Personal Information accurate.  To access, correct, change, update or delete your Personal Information on our Website, visit and log into your account. If you do not have an account, you may also make a request by contacting privacy@frontofficesports.com.  We promptly record any request for changes to your communication preferences in our internal customer databases; please allow up to 30 days for these changes to take effect.

      Except for requests to direct that your Personal Information not be shared or sold, we may ask for limited additional identifying information to verify your identity when you make a request. If you have an account with us, we may ask that you verify your identity through our account authentication process. These verification measures are designed  to protect against fraud.

      Deleting your Personal Information may result in the closing of your account and inability to access the Services. However, you can always re-register at any time.

      B. California Website visitors and customers

      In accordance with the requirements of the California Consumer Privacy Act, as amended, you may have certain rights in relation to your Personal Information.  These rights may include the rights to: 

      • Access and receive a portable copy of your Personal Information;
      • Delete your Personal Information (subject to certain limitations under applicable law);
      • Receive information about our use of your Personal Information;
      • Be free from discrimination in response to exercising these rights conferred by law; and
      • Direct that your Personal Information not be sold. 
      • Direct that your Personal Information not be shared for targeted advertising purposes.

      In addition under the California “Shine the Light” law, California residents are entitled to request and obtain from us once per calendar year information regarding the disclosure of your Personal Information, if any, with other businesses for their own direct marketing use. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which such information was shared in the immediately prior calendar year. Please note that we will not share your Personal Information with any third parties for their own marketing purposes unless we notify you at the point of collection, such as when you sign up for an event co-sponsored by FOS and another sponsor with whom registrant data may be shared.

      To exercise any of the above rights, please make a request by using the Consent Preferences link at the bottom of our Website home page, using this form, or by contacting us at privacy@frontofficesports.com  with “California Privacy Rights Request” in the subject line. We will acknowledge receipt of your request within 10 business days and make reasonable efforts to accommodate your request within 45 calendar days.  However, we reserve the right to reject such access requests or to impose restrictions or requirements upon such requests, including if applicable confirmation of conferred authority for any requests made by authorized agents, if required or permitted by applicable law.  

      If you are a California resident under the age of 18, and a registered user of our Website, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please use this form or send an email with a detailed description of the specific content or information to privacy@frontofficesports.com,  along with a description of the posted content or other information to be removed. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

      A number of other U.S. state laws provide some or all of the privacy rights provided under California law.  We honor all such data rights and comply with each relevant state’s privacy and data protection laws.

      D. EU/UK/Swiss Privacy Rights

      Where the processing of your Personal Information is subject to EU, UK or Swiss data protection laws, you have the following data subject rights. Please note that these rights are not absolute and in certain cases are subject to conditions as specified in applicable law.

      If you have any questions about the type of Personal Information we hold about you, please send a written request to privacy@frontofficesports.com or to the postal address provided at the bottom of this Privacy Policy.  If you wish to request deletion or correction of Personal Information we hold about you, or to exercise any other data subject right, please make a request by using the Consent Preferences link at the bottom of our Website home page, using this form, or contacting us at privacy@frontofficesports.com with “Data Rights Request” in the subject line.  While we will make reasonable efforts to accommodate your request, we reserve the right to reject such access requests or to impose restrictions or requirements upon such requests if required or permitted by applicable law.

      E. Canadian Website visitors and users

      We take appropriate steps to comply with applicable Canadian data privacy requirements regarding Personal Information of Canadian residents under the Canada Anti-Spam Legislation (CASL) and the Personally identifiable information Protection and Electronic Documents Act (PIPEDA), as amended from time to time.  Please note that FOS is a U.S. company subject to the laws of the United States of America.  Because FOS stores customer and Website visitor Personal Information in the United States, the stored Personal Information is subject to U.S. laws and may be made available to the U.S. government in the case of a lawful order in that jurisdiction. This Privacy Policy is intended to provide the required notices regarding our collection and use of personally identifiable information, including transfer to the United States.

      You may request to access, correct, or delete your Personal Information, or withdraw consent to our collection, use or disclosure of your Personal Information, by contacting us at privacy@frontofficesports.com.

       

      11. SECURITY

      The security of your Personal Information is important to use.  FOS follows generally accepted standards to protect your Personal Information from misuse, interference and loss, as well as from unauthorized access, modification and disclosure.  We have implemented technical, administrative and physical security measures to protect your Personal information, including:  

      • Using encryption when collecting or transferring sensitive Personal Information; 
      • Limiting access to the information we collect about you;
      • Ensuring that we and our service providers and business partners have appropriate security safeguards to keep Personal Information secure; and
      • Where required by law, destroying or de-identifying Personal Information.

      While we strive to protect your information, no data transmission over the Internet is 100% secure and, consequently, we cannot guarantee or warrant absolute security of any information you transmit you provide.  You are responsible for choosing a secure password when you create an account to access our Website.  We encourage you to keep any passwords you use confidential and to choose a password that you do not use on any other website.  Be careful to avoid “phishing” scams, including where someone may send you an email that appears to be from FOS asking for your Personal Information.  We will not request your ID or password through email.

       

      12. DATA RETENTION

      We retain Personal Information only for as long as reasonably necessary for the purposes for which it was collected, including to provide you with our Services, including your subscription to one of our newsletters. This retention will continue in accordance with our retention practices and legal requirements as necessary, for example, to comply with our legal obligations, resolve disputes, and enforce our agreements.  We may anonymize your Personal Information (so that it can no longer be associated with you) for research or statistical purposes.

      Our retention periods vary depending on the type of information and the reason it was collected.

       

      13. CHILDREN’S INFORMATION

      FOS takes children’s data privacy seriously.  We do not knowingly collect Personal Information from children through our Website or Services, which are not intended to be used by children.  If you are a child as understood by laws of your state or country, please do not submit any Personal Information through our Website. If  we learn that a child has submitted Personal Information about himself/herself to us, we will delete the information as soon as possible.

       

      14. LINKS TO THIRD-PARTY WEBSITES

      The Services may contain links to and from third party websites of our business partners and various contact management services and other service providers. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check their individual privacy policies before you submit any Personal Information to those websites.

      Our provision of a link to any other website or location is for your convenience and does not indicate our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for these outside websites or their content. Please be aware that the terms of our Privacy Policy do not apply to these outside websites.

      We may modify this Privacy Policy from time to time. We will notify you of changes by posting changes on the Website or by other appropriate means and the effective date of the updated policy.
